Email Hosting Terms of Service
Altokom Limited agrees to provide Web Hosting Services to the Subscriber, subject to the following Terms of
Service (TOS). All Services provided by ALTOKOM LIMITED, may be used for lawful purposes only. By using our
Services, you agree to comply with our policies. All provisions of this contract are subject to the TOS of
You agree to use all ALTOKOM LIMITED services and facilities at your own risk. ALTOKOM LIMITED specifically
disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall ALTOKOM
LIMITED be liable for any loss, or loss of data, or other commercial damage, including but not limited to
special, incidental, consequential or other damages. Subscriber agrees that it shall defend, indemnify, save
and hold ALTOKOM LIMITED harmless from any and all demands, liabilities, losses, costs and claims, including
reasonable attorney's fees asserted against ALTOKOM LIMITED, its agents, its customers, officers and employees,
that may arise or result from any service provided or performed or agreed to be performed or any product sold
by customer, it's agents, employees or assigns. Subscriber agrees to defend, indemnify and hold harmless
ALTOKOM LIMITED against liabilities arising out of: Any injury to person or property caused by any products
sold or otherwise distributed in connection with ALTOKOM'S LIMITED server. Any material supplied by Subscriber
infringing or allegedly infringing on the proprietary rights of a third party Copyright infringement any
defective products sold to customer from ALTOKOM'S LIMITED server. ALTOKOM LIMITED shall be the sole judge of
what violates this Policy.
ALTOKOM LIMITED is committed to a zero-tolerance, anti-spamming policy. ALTOKOM LIMITED defines spam as
unsolicited broadcast or commercial email that is sent to addresses that do not affirmatively and verifiably
request such material from that specific sender. Accounts cancelled due to spam are subject to a "clean up" fee
of N100,000. This policy protects our customers as well as the larger Internet community from the negative
effects of "spam" related activity.
Bandwidth and Disk Usage Policy
Subscriber agrees that ALTOKOM LIMITED will monitor and meter Subscriber's bandwidth and disk usage and in the
event that Subscriber exceeds the bandwidth or disk usage allocated to each hosting package ALTOKOM LIMITED may
take corrective action which may, at ALTOKOM'S LIMITED sole discretion, include the assessment of additional
charges, disconnection or discontinuance of any and all Services, or termination of this Agreement. Subscriber
agrees that in the event of a dispute ALTOKOM'S LIMITED monitoring reports shall be the final method of
determining how much disk space and bandwidth was used and agrees to pay the excess usage charges when due.
30 day Money back gurantee
Altokom Ltd offers a 30 day moneyback guarantee. If you arent happy with our service, email us within your
first 30 days of service and we will ensure you get a 100% refund on the fees paid less the setup fee. One 30 day
moneyback refund for Customer allowed per 180 days to prevent abuse. No refunds will be made available for
Customer's account which break any terms of the TOS. No refunds will be available for third party related
services including, but not limited to scripts installation, certificates, custom programming, scripting and
designing work, domain names registrations and transfers. As a conclusion, refunds are for Altokom's web
hosting packages only. After the end of the 30 day period the Billing & Payment Policies apply on all services.
Refunds sent without processing fees applied on them.
Billing and Payment Policy
All fees for Services are due in advance and shall be in accordance with ALTOKOM'S LIMITED fee schedule, which
is incorporated herein by reference and may be amended from time to time. Accounts will be automatically
rebilled prior to the expiration of services by email. ALTOKOM LIMITED will make it's best effort to notify
the client via e-mail that the clients renewal is due. However it is the sole responsibility of the client to
make sure they pay for renewal of services prior to Service expiration. Service will be interrupted on accounts
that reach 5 days past due. Customer agrees to pay a N5000.00 (five thousand Naira) late fee if customer's
account or accounts become more than five (5) calendar days overdue. In addition, in the event that any amount
due ALTOKOM LIMITED remains unpaid ten (10) calendar days after such payment is due, ALTOKOM LIMITED, in its
sole discretion, may immediately terminate this Agreement, and/or withhold or suspend Services. Subscriber
agrees that ALTOKOM LIMITED may charge a N6000.00 (six thousand Naira) fee to reinstate accounts that have been
terminated or suspended. ALTOKOM LIMITED is not responsible in any way for any loss of revenue or business due
to account suspension or deletion. All taxes, fees and governmental charges relating to the Services provided
hereunder (other than income taxes of ALTOKOM LIMITED) shall be paid by Subscriber.
Requests for canceling accounts must be made in writing with at least 7 days notice before your billing date
and sent to: billing[@]altokom.com . Setup fees, domain costs, and hosting services are non refundable. It is the
Subscriber's responsibility to confirm the cancellation was received by ALTOKOM LIMITED.
ALTOKOM LIMITED shall not be liable for failure or delay in performing its obligations hereunder if such
failure or delay is due to circumstances beyond its reasonable control, including, without limitation, acts of
any governmental body, war, insurrection, sabotage, embargo, fire, flood, strike or other labor disturbance,
interruption of or delay in transportation, unavailability of, interruption or delay in telecommunications or
third party services (including DNS propagation), failure of third party software or hardware or inability to
obtain raw materials, supplies or power used in or equipment needed for provision of the Services.
Altokom Limited reserves the right to add, delete, or modify any provision of this Policy at any time without
notice. The date of last modification to this policy was 10th August 2005.
